TORT OF NEGLIGENCE! WHO is liable?
ok i got a question saying that this guy is called to a salon to check a sunbed. he negligently misses a vital reading and says its ok. in fact it gets jammed and it overheats, and the salon employees sometime have to lift the lids for the clients. This employee is supervising maria who is in the sunbed. she has instructions to keep an eye on the bed but she goes outside and negligently leaves maria. maria is later burned because of this. i know both the maintenance and the supervisor were negligent but i cant establish causation! who is liable? are they both? if u know gimme the relevant case please. OH and btw i have been racking my brains for this for the last 2 days. the only relevant cases i could find were material contribution to harm cases which all involve people contracting diseases from different eployers which is hard to apply to my case. 10 points will be given straight away!
Your difficulty is based on the fact that there are two separate cases here, and possibly three. If you examine them individually, the legal situation gets clearer.
First, the owner of the salon (not the employee) is liable to Maria. Her damages are her burns, and her injuries are due to the salon's failure to properly administer a tan, properly train its employee (who should not have gone outside), and properly supervise the employee. This case is simple and straightforward. No complex legal authority is required, because this sort of negligence has been the law since British common law began. Every US state would support this interpretation, and there would be hundreds of citations available for the ideas that 1) the vendor (salon) has a duty of care; 2) failure to administer a service in a professional manner is a tort; and 3) the salon is responsible rather than the employee, under the doctrine of "respondeat superior."
The second case is the liability of the inspector to the salon. The salon's damages are measured by the loss it must pay to the customer. This case is considerably more complex, because the inspector might have a defense that the actual damages were caused only by the failure to supervise the tan rather than the inspector's failure to catch an warning signal. In most US jurisdictions, however, the chances are that the inspector would be found to be contributorily negligent, and part of the salon's liability would be assigned to the inspector. Not all US states recognize the concept of contributory negligence however, so the legal advice would depend on jurisdiction. The same considerations of employer vs. employee liability would apply here. The material contribution cases would be relevant in this context.
The third potential case would be the customer's direct case against the inspector. A competent lawyer would usually recommend against suing only the inspector, because the intervening negligence of the salon is clear. In the usual circumstance, however, the victim would sue both the salon and the inspector, allowing the jury or the parties to sort out what percentage of the liability should be assigned to each of the defendants.
